It is easy to spot a loser!

It has been my experience that it is easy to spot a loser by their actions when confronted with change. They will lye, cheat and deceive to maintain their guise as winners. They are frightened little people who use tactics like dirty tricks in political campaigns or personal attacks on their opponent rather then address the issues, or shout down opposing views in an attempt to drown out the truth. But a whispered truth has more clout than an incessant lye!

Like a racists of the past, they are appalled by the election of our black president and will reject anything he attempts in an effort to steer the country in their own narrow minded direction.

Those of us who seek to better our country know that we can not stoop to their level if we ever hope to purge these bigots from our society. I feel sorry for them, having to live in a country that has moved on, leaving them to wallow in their own self righteous beliefs. They are slowly becoming dinosaurs in a changing world where if you reject change you will be left fading into history, only to leave dust angles on the floor of time.

Their myopic views leave them frightened by what they do not understand and incapable of empathizing with people of a different color, religion, ethnicity or sexual orientation. It means that we must offer them some compassion since they will not receive any from their cohorts.

Corporate Corruption and Bribery

The latest ruling from the Supreme Court will open the flood gates for corporations to take over our government. It is time to challenge the original ruling that has allowed corporations to act as citizens and not as a artificial person as intended.

The Preamble to US Constitution says: We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.

The United States Constitution was adopted on September 17, 1787, by the Constitutional Convention in Philadelphia, Pennsylvania, and ratified by conventions in each U.S. state in the name of “We The People” not “We The Corporation”!

In 1819, the U.S. Supreme Court granted corporations rights as an “artificial person,” possessing both individuality and immortality.

The definition of corporation (from Lat. corporare, to form into a body, corpus, corporis), in English law is an association of persons which is treated in many respects as if it were itself a person. It has rights and duties of its own which are not the rights and duties of the individual members thereof. Thus a corporation may own land, but the individual members of the corporation have no rights therein. A corporation may owe money, but the corporators as individuals are under no obligation to pay the debt.

In 1819, the U.S. Supreme Court did not make corporations Natural Persons and therefor, acording to the preamble and the US constitution, did not afford them the rights of a US Citizen!

A legal person, also called juridical person or juristic person, is a legal entity through which the law allows a group of natural persons to act as if they were a single composite individual for certain purposes. (the key words being for certain purposes) This legal fiction does not mean these entities are human beings, but rather means that the law allows them to act as persons for certain limited purposes—most commonly lawsuits, property ownership, and contracts. The key words here being, (limited purposes)!

It does not grant them the right to lobby publicly elected officials.

Basic rights (like the rights to free speech and due process of law) do not necessarily follow from legal personhood.

In jurisprudence, a natural person is a human being, as opposed to an artificial, legal or juristic person, i.e., an organization that the law treats for some purposes as if it were a person distinct from its members or owner. Under 11 CFR 114.2 and 114.5, the Federal Election Commission puts Corporations, Labor Organizations, National Banks and Incorporated Membership Organizations on an equal footing with regard to contributions to candidates running for office, but corporations and national banks employ natural people and do not represent them or their interests, unlike labor unions and incorporated membership organizations that do. This mistake is at the root of the problem.

According to 11 CFR 114.2 and 114.5 contributions made from the treasuries of corporations, labor organizations and national banks are prohibited. Additionally, national banks and federally chartered corporations may not make contributions in connection with any election, including state and local elections. Contributions may, however, be made from separate segregated funds (also called political action committees or PACs) established by corporations, labor organizations, national banks, and incorporated membership organizations.

Since corporations and banks only employ natural people but do not represent them or their interests, like labor unions and incorporated membership organizations do, I contend that it does not entitle them to lobby our duelly elected officials on their behalf.

This means that any lobbying by a corporation is done on and in the best interests of the corporation and does not represent the best interests of We the People as stated in the Preamble. Since profit is the sole purpous of corporations and banks, it stands to reason that giving corporations and banks an avenue to contribute or advertize in campaigns of our elected officials and then allowing them to lobby those very same officials is in direct conflict with the general welfare of We the People as stated in the preamble.

All citizens of the United States should strongly protest any lobbying of their represenitives by corporations and banks or their represenitives as this is a breach of our constitunal rights.

Legally speaking, bribery is the offering, giving, receiving, or soliciting of something of value for the purpose of influencing the action of an official in the discharge of his or her public or legal duties. The expectation of a particular voluntary action in return is what makes the difference between a bribe and a private demonstration of goodwill. To offer or provide payment in order to persuade someone with a responsibility to betray that responsibility is known as seeking Undue Influence over that person’s actions. When someone with power seeks payment in exchange for certain actions, that person is said to be peddling influence. Regardless of who initiates the deal, either party to an act of bribery can be found guilty of the crime independently of the other. When corporations contribute equally to more than one campaign of political parties, the only purpose this can serve is to buy influince. Websters definition of a bribe is (money or favor given or promised in order to influence the judgment or conduct of a person in a position of trust) and by contributing and then lobbying those elected officials corporations are guilty of bribery and collusion and should be prosicuted under the law.

When corporations contribute to more than one political campaign for public office they along with the campaigning person are guilty of bribery and they along with the corporation under their status as an artificial person can and should be prosicuted to the fullest extent of the law for the crime.

For example, such legal provisions as Amendment XIX to the United States Constitution, which guarantees a woman’s right to vote, or Section 15 which guarantees equality rights, apply to natural persons only. In many cases fundamental human rights are implicitly granted only to natural persons; a corporation cannot hold public office, but it can file a lawsuit and thearfor can be prosicuted.

The Ninth Amendment declares that the listing of individual rights in the Constitution and Bill of Rights is not meant to be comprehensive; and that the other rights not specifically mentioned are retained by the people.

The US courts are interested in any clues about the Constitution’s meaning which they can find in the Preamble. Courts have developed several techniques for interpreting the meaning of statutes and these are also used to interpret the Constitution. As a result, the courts have said that interpretive techniques which focus on the exact text of a document should be used in interpreting the meaning of the Constitution and so the Preamble provides additional language against which to compare other parts of the Constitution. Balanced against these techniques are those that focus more attention on broader efforts to discern the meaning of the document from more than just the wording; the Preamble is also useful for these efforts to identify the “spirit” of the Constitution.

Additionally, when interpreting a legal document, courts are very often interested in understanding the document as its authors did and their motivations for creating it; as a result, the courts have cited the Preamble for evidence of the history, intent and meaning of the Constitution as it was understood by the Founders. Although revolutionary in some ways, the Constitution maintained many common law concepts and the courts feel that the Founders’ perceptions of the legal system that the Constitution created are uniquely important because of the authority “the People” invested them with to create it. What chance does the voting public have of influincing the votes of their officials when those officials are taking millions of dollars from corporations and now will be advertized against or for in their campaigns.

It is a conflict of interest for an elected official to claim to represent their constituants when they are accepting donations from major corporations whos interests are in direct conflict with the general Welfare and Posterity of  We The People! It would be in the best interest of the American People to challenge the Federal Election Commission rulings 11 CFR 114.2 and 114.5. in the US Supreme Court and put a stop to this injustice.

Corporations now have all the privileges of citizenship, without any of the responsibilities.” This constitutes giving them all the rights provided citizens under the constitution without any checks to the system.

IS YOUR GOVERNMENT SUBSIDIZING CRIME AND CRIMINAL ACTIVITIES?

Consider the following;

Abolish the current complex Tax System by slowly phasing in a simple Progressive Federal Sales Tax and Watch what happens!

First: When you get paid $10 per hr. you receive $10 per hr. Remember no income tax! (A progressive sales tax is were you buy an item, lets say from $0 to $10 and the sales tax might be 5% and a $10 to $100 item might be 10% and so on.) So now the tax is higher on big ticket items. The rich pay a bigger portion of the taxes because they buy more expensive things like Hummers, yacht and personal jets. Rather than less taxes because they can afford expensive accountants, who can find loop holes built in to the tax laws by their friends in Washington. This is true trickle down economics!

Second: Whenever making purchases, all of the following criminals and tax cheats will pay their fair share of taxes. Drug dealers, prostitutes, money launderers, thieves, racketeers, illegal gamblers, illegal aliens, people who work under the table, people who make tips and those who lie on there tax returns, etcetera to infinitum. (To many to mention) These job titles do not get put on 1040 tax returns at the end of the year.

If all these taxes were collected, and you are an honest tax payer, the percentage of federal sales taxes would be miniscule and the amount you pay in taxes would go down dramatically. The sheer volume of these uncollected taxes is staggering! It could conceivably abolish the national debt with enough left over to bail out social security and cover national health care costs.

Third: If these people were paying their fair share of taxes, the criminal activities they are engaged in, would become considerably less profitable and they would be less likely to start, succeed or continue in that criminal activity. This would result in a reduction in all crimes across the board and free up law enforcement so they can better take care of the honest citizens.

Fourth: Think of this! No IRS in your life. No April, 15 deadlines. No complicated tax codes you can’t figure out and that favor the rich. No paying expensive accountants to do your taxes because you can‘t. No saving receipts and records for years. No audits by our friends at the IRS! No more 1040 instruction books that keep getting larger every year. Think of the money the government will save by not printing and mailing them. Plenty more you can think of yourself

Fifth: Most states already have a state sales tax in effect, that has been proven to work. The IRS could oversee the collection of the taxes, by the businesses collecting them just as the states do, rather than intimidating millions of honest working Americans. The US Government should welcome this form of taxation, as it would increase tax revenues and reduce the work load of the IRS. No business man would dare to cheat the IRS and jeopardize his business, just to give someone a break on there taxes!

Sixth: You wouldn’t pay taxes until you spend the money, thus encouraging saving and investing, boosting the economy. Ask your self, how much of your earnings did you manage to keep last year?

Seventh: The current income tax system, taxes your income thus discouraging earning more money. The more you make the more they take. Unless you are rich and can afford one of those high priced accountant, who can find you that loop hole, in which case you will not want this type of taxation.

Eight: You don’t need to figure out what kind of a complicated IRA, ROTH, 401K, or KEO you need to retire on. You don’t pay taxes until you spend it! So just save in what ever fashion gives you the best return and get interest on all your money, then pay your federal sales taxes when you retire.

Finally: You will notice that no politicians are promoting this tax system. This is a very good sign that it is in your best interest. This system, will not line the pockets of there rich cronies.
